This is what I received from my attorney (www.emvisa.com):
Visa Spotlight: H-1B Visa Petitions Processed in 15 Days or Less
Beginning July 30
Employers will soon have the opportunity to obtain faster
processing of H-1B petitions under the new INS Premium Processing
Program. Starting on Monday, July 30, the INS will add the H-1B
category to the list of categories eligible for premium processing.
Under this program, the INS guarantees that they will issue either
an approval notice or a request for additional information within
15 calendar days of receiving the petition. If the INS fails to
meet its 15-day guarantee, it will refund the $1,000 fee. The INS
is currently taking between three to six months to adjudicate H-1B
petitions.
E&M clients interested in filing at the outset of the program for
H-1Bs are encouraged to direct their E&M legal team to begin the
LCA (Labor Condition Application) process for their job candidate
or employee as soon as possible. (Premium processing for E-1,
Treaty Trader; E-2, Treaty Investor; L-1 Intracompany Transferee
and O-1 Alien of Extraordinary Ability visa petitions began on June
1.)
Note: if and when the H-1B cap is met, premium processing for H-1B
visa petitions will be terminated for all pending H-1B visa
petitions filed for processing in the current fiscal year (ending
September 30, 2001).
